O-1B Approval for Canadian Designer

We recently received an approval on a change of status to O-1B for a Designer who is a citizen of Canada. Congratulations to our client!

Our client was working at a design agency in the United States in TN status. Graphic Design is one of the eligible professions established under the North American Free Trade Agreement (NAFTA); Canadians and Mexicans may work in this field in TN status through a petitioning company. However, since TN status is tied to one employer, our client was not authorized to take on freelance work which was limiting the growth of his career. Through an agent, he applied for O-1B status which permits him to take on additional freelance design gigs apart from his full-time position as the design agency. It was approved without a request for evidence.

I have more than a decade representing artists obtain O-1B status in the United States. To schedule a consultation, please email me at amir@rasoulpourlaw.com.
