O-1B Approval for Taiwanese Fashion Designer
We recently received an approval for an O-1B change of status for a fashion designer from Taiwan. Congratulations to our client!
This petition was approved after a request for evidence (RFE) was issued. While it can certainly be discouraging and stressful to receive an RFE, it does not mean that the case is not approvable. In spite of best efforts in presenting a complete case at the time of an initial filing, sometimes an RFE is issued for any number of reasons. While an O-1B has some subjectivity to it, there are nonetheless concrete legal standards that you must prove and those are screened for prior to applying in the first place. The RFE is just another opportunity to clarify how you qualify and perhaps also supplement the record of evidence.
