O-1B Extension Approved for Thai Creative Content Producer

We recently received an approval on a 3-year extension for a Thai Creative Content Producer. Congratulations to our client!

This is the 3rd O-1B petition we have handled for this client, who is a part-owner of a business entity that is the petitioner on the O-1B petition. There is no prohibition to the beneficiary being an owner of the petitioning business entity for an O-1B visa and this ownership is disclosed on the I-129 petition. The beneficiary works in a niche field of advertising related to Thai businesses in the United States through the petitioning company.

If you have a business or are considering opening a business, an O-1B might be an option, as opposed to an E-2 visa which requires significant capital as well as requiring specific nationalities for eligibility. Unlike an E-2, however, you will need to demonstrate extraordinary ability in the field. I’d be happy to have a consultation with you to discuss which visa route may best fit your goals. Feel free to reach out to me at amir@rasoulpourlaw.com to schedule a consultation.
