Renewal of Permanent Residence Approval After RFE for Chilean National
We recently represented a Chilean national to respond to a request for evidence related to their green card renewal which was subsequently approved. Congratulations to our client!
Our client had submitted an I-90 with alternative counsel and the USCIS issued a request for evidence because there was a small discrepancy in her name on the passport she submitted and her LPR card. Our client is dual national: born in Chile but with acquisition of citizenship in France, and her French passport spelled her first name slightly differently. After some research, we determined that this discrepancy was due to laws in effect at the time our client was born that did not permit her birth name to be registered in France as it was written on her Chilean birth certificate. We provided this explanation, along with a copy of her Chilean birth certificate and passport, to evidence that her legal name at birth matches what is on her lawful permanent resident card. It was approved shortly after submitting this response.
