Spousal Based Green Card Approval for Turkish National
We recently received an approval for an adjustment of status to lawful permanent resident (green card holder) for a Turkish national. Congratulations to our client!
In this case, the marital couple were not living together at the time of the marriage and the filing of the petition. While cohabitation is a consideration for determining whether a marriage is bona fide (i.e. not entered into solely for immigration purposes), it is not a requirement. In this case, the couple was young and had already entered into separate lease agreements & had just moved in with one another prior to the interview. All of this was explained to the Officer through the submission and was balanced through other evidence that the couple had a bona fide marriage.
