Spousal Green Card Approval for Uzbek National

We recently received an approval of an adjustment of status to lawful permanent resident for a national of Uzbekistan who married a US citizen after her OPT period. Congratulations to our client!

The US citizen spouse and the Uzbek beneficiary did not live together because it was not in the best interest of the US citizen spouse’s teenage daughter from a prior marriage; while they live close by to one another and otherwise fully are a part of each other’s lives, living together was not the right option at this time for family stability. Cohabitation is NOT a requirement for a marriage petition to be approved, and we provided information about their living situation and the reasons for it in the initial filing. The interview went very smoothly at the Brooklyn Field Office and it was approved the next day.

There are many ways to prove to immigration that a couple has a bona fide marriage. It is the burden of the applicants to demonstrate that they have an intention to live a life together— and living a life together does not always mean living in the same apartment.
