Green Card based on U-3 Status Approval for Ecuadorian National
We recently received an approval for lawful permanent residence (a green card) based on 3-years of continuous presence in U status for an Ecuadorian national. Congratulations to our client!
U status is for victims of certain crimes in the United States who have suffered harm and cooperate with authorities to prosecute the crime. Benefits are also available to children of the U-1 principal, and the children are U-3 nonimmigrants. To obtain U-3 status, you had to have been under 21 when the U petition was filed; if you later age out, you still maintain eligibility for U-3 status. In this case, my client was under 21 at the time her father, who is the U-1 principal, filed the U nonimmigrant petition. She obtained U-3 status through him, even after the age of 21, and then after three years in U-3 status, she was eligible to apply for permanent residence.
